In the photo, the San Francisco meter maid looks ecstatic -- her arms thrown above her head and a jubilant smile on her face as she crosses the finish line after completing a 10-kilometer race.
That's not the picture jurors were painted in Mercy Zamora's trial when she sued cart maker Cushman, Inc., and her employer, the city of San Francisco, after she was injured in an on-the-job cart crash, according to the San Francisco Recorder's "Legal Pad" blog.
In fact, according to defense attorney Edward Hugo, her lawyer Thomas Brandi (a past president of the California personal injury lawyers organization), in the case, told the jury she "had lost the ability" to perform in such activities. Hugo says he introduced the photo after Zamora's husband testified that his wife could no longer compete in road races or do other strenuous activity.
The jury did award $1.6 million against Cushman and the city, but awarded zero for future pain and suffering.
